1. Acceptance and Definitions
By accessing and using the ECONOMATICA platform, the USER declares that they have read, understood, and fully agreed to the terms, conditions, and policies set forth herein, including any future updates. Clicking “I Have Read and Accept the Terms and Conditions of Use” or continuing to access Economatica’s systems after a new version is published constitutes express consent, with the same legal effect as a handwritten signature, pursuant to applicable law. For security and proof of acceptance purposes, Economatica may record the date, time, IP address, and version of the Terms accepted at the time of confirmation.
For purposes of this document:
- USER means any individual or legal entity, whether a client or authorized by the contracting party, that uses the Platforms;
- END USER means the individual affiliated with the Client who holds exclusive, individual access credentials to operate the Platforms;
- CLIENT means the individual or legal entity that contracts the services;
- DISTRIBUTOR means ECONOMATICA, as an entity authorized by original sources (including, without limitation, B3, ANBIMA, CVM, BACEN, and others) to transmit and make market data available to Users;
- ECONOMATICA is the owner of the Platforms and the controller of the associated databases and systems.
2. License of Use and Access
ECONOMATICA grants the USER a limited, non-exclusive, non-transferable, and revocable license for internal, professional, or academic use, as provided under the applicable agreement.
The following are prohibited: sublicensing, reselling, sharing credentials, reverse engineering, scraping, or redistributing content without express authorization.
3. Intellectual Property
All rights to the software, databases, interfaces, design, APIs, and trademarks belong exclusively to ECONOMATICA or to the licensed original sources (B3, ANBIMA, CVM, BACEN, among others).
All rights to derived data, proprietary metrics, and analytical calculations developed by ECONOMATICA based on raw data are the exclusive property of ECONOMATICA.
The USER acknowledges that derived data created by ECONOMATICA does not allow reverse engineering to obtain the original data from licensed original sources (such as B3 and ANBIMA).
Use of the Platforms does not grant the USER any intellectual property rights—only the right to use the Platforms while the agreement remains in effect.
4. Misuse and Redistribution of Data
Redistribution, extraction, reproduction, republication, or commercialization of data and information obtained through the Platforms is prohibited.
Limited, occasional use of small portions of data for internal reports and analyses is permitted, provided that ECONOMATICA is cited as the source.
ECONOMATICA reserves the right to monitor access patterns, traffic volume, and connection IPs to ensure security and compliance with these Terms.
If conduct consistent with bots, scraping, or credential sharing is identified, ECONOMATICA may immediately suspend access, without prior notice, for audit purposes.
5. Errors, Delays, and Limitation of Liability
ECONOMATICA uses its best efforts to ensure data accuracy and availability, but it is not liable for any errors, delays, interruptions, or failures resulting from force majeure, maintenance, or external failures.
ECONOMATICA shall not be liable for any indirect damages, lost profits, loss of revenue, loss of data, or losses arising from investment decisions made by the USER based on the information provided.
ECONOMATICA’s total liability, for any reason, is strictly limited to the amount paid by the USER for the month in which the event occurred.
6. Commitment to Original Data Sources
Data provided through the Platforms may include information originating from external sources, such as B3, ANBIMA, BACEN, CVM, and other providers.
Such data is subject to the terms and conditions imposed by its owners. The USER acknowledges awareness and acceptance of such conditions and is responsible for complying with them.
7. Specific Terms of Use for B3 Data
The USER hereby acknowledges and agrees that market data and analytical information (including market data dissemination (“Market Data”) and UP2DATA data, collectively referred to as “B3 Data”) are governed by the following terms and conditions, which reflect the obligations assumed by the DISTRIBUTOR toward B3 S.A. – Brasil, Bolsa, Balcão (“B3”), the sole owner of the rights to B3 Data.
(i) Ownership and Rights: B3 is the sole owner of all rights related to B3 Data, including intellectual property rights and any modifications. The USER undertakes to respect such rights and not to remove or alter any notices, alerts, copyright notices, and/or product or service trademarks contained in B3 Data.
(ii) Nature of Authorization and Internal Use: This limited authorization does not grant the USER any right, title, ownership (including intellectual or moral rights), interest, or any other prerogative over B3 Data. B3 Data may be used by the USER solely for operational purposes and internal analyses or to support investment decisions, and any external use is prohibited, except as expressly authorized by B3.
(iii) Specific Prohibitions (Indices and Financial Instruments): Unless with B3’s prior and express written consent, use of B3 Data is not permitted for: (a) preparing, creating, calculating, or generating any type of index, rate, benchmark, and/or similar; or (b) preparing, creating, calculating, and/or generating any financial instruments or securities (e.g., options and derivatives) for the benefit of the USER or third parties, including free of charge.
(iv) Prohibition on Distribution/Redistribution: The USER may not distribute, redistribute, transfer, transmit, retransmit, license, sublicense, lease, lend, sell, resell, recirculate, reformat, disclose, publish, or provide standalone services based on B3 Data, except with B3’s prior and express consent.
(v) Protection and Care: All of B3’s proprietary rights must be protected during and after the termination of use with the same degree of care used to protect the USER’s own property.
(vi) B3 Audit Right: B3 or a representative designated by B3 may, upon 30 (thirty) days’ prior notice, audit the USER’s books, records, and data reception systems.
(vii) Indemnification: The USER must indemnify and hold harmless B3 and the DISTRIBUTOR from all losses caused by improper use of B3 Data.
(viii) No Warranty: B3 does not warrant the sequence, timeliness, accuracy, or completeness of B3 Data, nor is it liable for any delays, errors, or omissions.
(ix) Precedence: The terms and conditions herein shall prevail over any other terms agreed between the USER and the distributor that are inconsistent or incompatible with these terms.
(x) Use of Marks: The USER may not use any B3 trademarks, symbols, distinctive signs, or identifiers without B3’s prior written consent.
(xi) Non-Display Use (B3): Any use of B3 Data that does not involve visual display to a human (such as feeding algorithms or trading systems) must be previously authorized and may be subject to additional fees.
(xii) Liability for Fines/Penalties: The USER must reimburse ECONOMATICA for any fines or penalties imposed by B3 arising from irregular use or unauthorized redistribution of data demonstrably carried out by the USER.
(xiii) Data Discontinuation: If B3 changes its policies or revokes ECONOMATICA’s distribution license, the provision of such data may be interrupted without giving rise to any right to compensation for the USER.
8. Specific Terms of Use for ANBIMA Data
The USER hereby acknowledges full awareness and acceptance of the following terms of use. These terms are imposed by ANBIMA – Associação Brasileira das Entidades dos Mercados Financeiro e de Capitais (the data owner) on the DISTRIBUTOR, and compliance is mandatory for access to the Database.
(i) Database: The dataset covered by these terms consists of quotations for certain Brazilian government securities, certain Brazilian debentures, and certain indices, identified in the ECONOMATICA system by the field “Exchange/Pricing Agency” filled in with “ANBIMA”. This dataset shall hereinafter be referred to as the “Database”.
(ii) Ownership: ANBIMA is the sole owner of the Database. The name and trademark ANBIMA, as well as its registered products, are its exclusive property, and reproduction or use is prohibited without prior and express authorization.
(iii) Exclusive Internal Use (Authorized): Access to the Database is granted solely for internal use. The END USER is authorized to use the raw data to feed their own databases, and the final use of the data must occur from such internal base exclusively in internal processes and studies.
(iv) Internal Development: Use of the Database to create and improve products, services, and processes exclusively for internal use is permitted.
(v) Market Reference: All indices, figures, indicators, and unofficial estimated calculations determined by ANBIMA itself must be used solely as market reference.
(vi) Derived Data: Derived data may be created provided that it is not possible to obtain the original data distributed by ANBIMA through reverse engineering, under penalty of liability for losses and damages.
(vii) Distribution and Commercialization: Any distribution or redistribution of the Database, as well as its commercialization or offering to third parties, is prohibited.
(viii) Creation of Indices and Synthetic Assets:
a) Development of indices based on the accessed data.
b) Creation of predefined aggregated products derived from primary information that may be characterized as synthetic assets, with only the provision of information in the form of performance indicators on an individual basis being permitted.
(ix) Extraction and Bots:
a) Use of bots and downloading the data, except through the contracted access mechanism.
b) Extraction of primary data (quotations, such as Unit Price, Yield) from the Database through means such as copy/paste or file export. Copying derived data (Technical Indicators) is permitted, however.
(x) Exclusive Risk: Use and disclosure of the Database are at the sole risk of the End User, who assumes full and exclusive responsibility for its use.
(xi) ANBIMA Disclaimer: ANBIMA does not guarantee the availability and continuity of the Database, nor its sequence, timeliness, accuracy, or completeness. ANBIMA disclaims liability for any damages or losses caused by the use of the data or by discrepancies and inaccuracies.
(xii) Lag: The USER acknowledges the possibility of lag or differences in results, which does not entitle the USER to any compensation from ECONOMATICA or on any grounds.
(xiii) Source Reference: When referring to the ANBIMA source, the USER must clearly and visibly indicate ANBIMA’s disclaimer of liability.
(xiv) Indemnification (ECONOMATICA): If the END USER breaches the terms of use, the END USER must defend ECONOMATICA against all ANBIMA-related claims and is responsible for all costs, losses and damages, and attorneys’ fees.
(xv) Gratuity and Fees: Access is provided as a courtesy by ANBIMA, creating no rights for the USER. ANBIMA may at any time change this policy and charge monthly fees, which will be passed through to the End User.
(xvi) Changes: ANBIMA may unilaterally modify, at any time, any conditions of this instrument and change the presentation and configuration of the Database.
(xvii) Revocation: ANBIMA may revoke authorization for the Database to be made available in the ECONOMATICA system, upon 7 (seven) days’ prior notice.
(xviii) Post-Termination Use: Upon termination of the agreement, disposal of the acquired database is not mandatory; however, offering, commercializing, or making such database available/distributing it (even free of charge) is prohibited, and it must be used solely as an internal database.
9. Privacy and Data Protection
The collection and processing of personal and business data by ECONOMATICA follow the guidelines of Brazilian Law No. 13,709/2018 (LGPD) and the Privacy and Data Governance Policy.

10. Term, Amendments, and Venue
These Terms take effect on the date of publication and will remain in effect as long as the USER uses any of the Platforms.
ECONOMATICA may, at any time, update these Terms to reflect changes to the Platforms, products, and services, the use of new technologies, or operational, contractual, or regulatory needs. The version in effect will be the one published on ECONOMATICA’s official channels, and periodic review is recommended. Continued use of the Platforms after an update constitutes acceptance of the new conditions.
ECONOMATICA may, at any time, modify, suspend, or discontinue features, products, services, or access to the Platforms, in whole or in part, including for technical, security, contractual, or regulatory reasons.
The USER acknowledges that some data made available may be subject to third-party terms and policies (e.g., original sources and data providers), including fees, changes in access conditions, or discontinuation. Any additional costs, taxes, or charges passed through to ECONOMATICA by such sources may be passed through to the USER, when applicable, upon prior notice, and the USER may terminate if they do not agree to the adjustment.
Violation of clauses related to Intellectual Property, Misuse, or Data Redistribution authorizes ECONOMATICA to terminate this instrument for cause, immediately, without prejudice to losses and damages.
After termination, any data and databases remaining in the USER’s possession must be used strictly for internal historical purposes, and offering, making available, or commercializing such data to third parties is strictly prohibited.
Brazilian law applies, and the courts of the City of São Paulo, State of São Paulo, Brazil, are elected as the exclusive venue to resolve any disputes. If in doubt, the USER may contact ECONOMATICA through its official channels.
